Rental Agreement

IDEA PARTY RENTALS INC.
BRAMPTON, ONTARIO

This Rental Agreement (“Agreement”) is between the customer named below (“Customer”) and Idea Party Rentals Inc. (“Company”), and applies to the rental of inflatable equipment, popcorn machines, cotton candy machines, bubble machines, and any other equipment provided by the Company (collectively referred to as “Rental Equipment”).

It is the sole responsibility of the person or organization hiring the Rental Equipment to ensure every precaution is taken to avoid injury or damage. All Rental Equipment must always be supervised by a responsible adult. Idea Party Rentals Inc. does not provide attendants for supervision, setup, or takedown.

RULES OF USE

(Applies to all Rental Equipment unless otherwise noted.)

The Customer is solely responsible for the safe, correct, and lawful setup, operation, and takedown of all Rental Equipment for the entire duration of the rental period.
A responsible adult must always supervise the Rental Equipment, including during setup and takedown. The Customer is fully responsible for the safety of all users.
Inflatable equipment is suitable for individuals aged 4 and above, including adults. Recommended max weight per user is 200 lbs. per person, not to exceed 700 lbs. total.
A maximum of 5 users (children) may be on the inflatable at any time. Mixed-age groups should be avoided to ensure safety.
No food, drinks, or chewing gum on or around the Rental Equipment. This helps avoid choking hazards and keeps the unit clean. A $90 cleaning fee will apply if the Rental Equipment is returned dirty (grass, mud, water, etc.). This amount will be deducted from the deposit after the inspection. Only water and soft cloth may be used to clean the unit. Do not use cleaning chemicals. Deflate before cleaning.
All users must remove shoes, glasses, jewelry, and badges before entering the Rental Equipment. Failure to comply may result in a $500 damage fee.
No face paint, party poppers, colored streamers, or silly string within 25 feet of the Rental Equipment. These items can cause permanent damage.
No smoking near any Rental Equipment at any time.
No climbing, hanging, or sitting on Rental Equipment walls. This is dangerous and strictly prohibited.
No rough play or unsafe behavior on any equipment.
No pets, toys, or sharp objects are allowed on the Rental Equipment. Violation will incur a $500 damage fee.
Do not use Rental Equipment units during inflation/deflation or during rain. Store blowers in a dry area if it rains.
For Rental Equipment, remove all items from pockets. No somersaults or acrobatics.

If the blower or powered machine stops, remove all the participants immediately. Check for obstructions, unplug, and wait 1-2 minutes before restarting. Call us if issues persist. If smoke or unusual sounds are observed, immediately power off the unit and contact us before attempting any further use. In the event of fire or electrical hazard, do not attempt repairs. Contact emergency services if needed.
The equipment must be returned clean, dry, and undamaged.
Rental Equipment must not be set up or dragged over rough surfaces (e.g., asphalt, gravel). The setup area must be cleared of debris in advance
Late returns will result in a full-day rental fee deducted from your deposit. Equipment must be clean, dry, and undamaged.

ADDITIONAL EQUIPMENT USE NOTES:

Popcorn and Cotton Candy Machines: Use only approved ingredients and follow safety instructions provided.
Bubble Machines: Place on a stable, level surface. Use only with approved bubble fluid.
Approved ingredients/fluids will be specified by Idea Party Rentals Inc. upon booking confirmation.
Cleaning fees and damage charges apply for misuse of any machine.
All machines must be returned in clean, dry, and working conditions. Failure to do so will result in applicable cleaning or damage fees.

LIABILITY DISCLAIMER

The customer acknowledges the receipt of all equipment in good condition and agrees to return it in the same condition.
The Customer assumes full responsibility for any injuries, damage, or losses related to the use of the Rental Equipment. The Customer hereby irrevocably releases and discharges Idea Party Rentals Inc., including its owners, employees, agents, and affiliates, from all claims, liabilities, or demands arising out of or related to the use of the Rental Equipment.
If any portion of this liability waiver is found to be unenforceable, the Customer agrees that any recoverable amount shall be limited to the total rental fee paid to Idea Party Rentals Inc.
Idea Party Rentals Inc. reserves the right to enter the premises at any time to reclaim equipment.
The customer may not loan, sublet, or use equipment at another location without written permission from Idea Party Rentals Inc.
The customer is liable for all repair costs including labor for any damage.
If the equipment is lost, stolen, or damaged beyond repair, the renter agrees to immediately pay the full replacement cost of the unit, as determined by Idea Party Rentals Inc. based on the current market value.

LEGAL AND ADMINISTRATIVE TERMS

This agreement is governed by the laws of the province of Ontario, and disputes shall be resolved in the courts of Brampton, Ontario.
Electronic signatures on this agreement are as binding as original signatures.
Any waiver of rights by the Company must be in writing. No oral agreements shall modify this contract.
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

DEPOSITS AND CANCELLATIONS

A refundable damage deposit of $250 or a full day rental price, whatever is higher is required prior to the rental. This deposit will be returned in full provided that all equipment is returned on time, clean, dry, undamaged, and in proper working condition.
Cancellations made less than 48 hours before the scheduled rental date may incur a cancellation fee equal to 50% of the total rental cost.

ACKNOWLEDGEMENT AND SIGNATURE

The person or organization renting this equipment is fully responsible for any damage or injury occurring during the rental period. By signing below, the renter confirms they have read and understood the terms and conditions of this agreement.
The Customer understands and agrees to a $90 professional cleaning charge if the Rental Equipment is returned with excessive dirt, mud, grass, water, food, gum, or other substances.
The customer is responsible for ensuring all users comply with this agreement.

The Customer acknowledges that they have been offered the opportunity to seek independent legal advice prior to signing this Agreement. The Customer agrees they are responsible for ensuring all users follow the rules outlined in this Agreement.

By signing below, the Customer acknowledges that they have read, understood, and agreed to the terms and conditions of this Agreement and accept full responsibility for the Rental Equipment during the rental period.
