Waiver and Release of Liability

IDEA PARTY RENTALS INC.

This Waiver and Release of Liability (“Agreement”) is executed on this ___ day of _________, 20, by the undersigned individual (the “Participant”), or the parent/legal guardian of a participating minor (the “Guardian”), in favor of Idea Party Rentals Inc., including its owners, officers, employees, agents, affiliates, contractors, representatives, and any third parties involved in the rental process (collectively referred to as the “Released Parties”).

ACKNOWLEDGEMENT OF RISKS: I acknowledge that participation in activities involving bounce houses, jumping castles, inflatable games, and other rental equipment (collectively, the “Equipment”) provided by Idea Party Rentals Inc. involves inherent and unanticipated risks such as falls, collisions, and malfunctioning equipment. These risks also include, but are not limited to, physical or emotional injury, paralysis, death, and property damage to myself, my child(ren), or third parties. I understand these risks and voluntarily choose to participate, accepting full responsibility for any resulting consequences.
HEALTH REPRESENTATION: I certify that I am in good physical health and do not have any medical conditions, impairments, or disabilities that would prevent me from safely using the Equipment or participating in related activities. I acknowledge and voluntarily assume all associated risks, both known and unknown.
ASSUMPTION OF RISK AND WAIVER: By signing this Agreement, I voluntarily assume all risks and accept full responsibility for any personal injury, death, or property damage that may arise from the use of the Equipment or participation in related activities—regardless of foreseeability.
RELEASE OF LIABILITY: I hereby release, waive, and discharge the Released Parties from any and all claims, demands, liabilities, or causes of action arising out of or related to the use of the Equipment, including claims based on negligence, acts or omissions, or any breach of express or implied warranties. I understand that by signing this release, I am waiving significant legal rights, including the right to sue.
SUPERVISION REQUIREMENT: I acknowledge that the Equipment must be used only under the constant supervision of a sober, responsible adult. The supervising adult must always maintain direct sight and control of all children during use. I understand the adult-to-child ratio should be sufficient to ensure safety, with at least one responsible adult for every 5 children.
ACKNOWLEDGEMENT OF SAFETY GUIDELINES: I confirm that I have received, read, and fully understood all safety instructions and guidelines provided by Idea Party Rentals Inc. I agree to comply with all usage and safety rules associated with the Equipment and take full responsibility for ensuring others under my supervision do the same.
MINOR PARTICIPANT CLAUSE: If the individual using the Equipment is a minor, I affirm that I am the minor’s parent or legal guardian and have full legal authority to sign this Agreement on their behalf. I understand that this Agreement is binding on both the minor and myself. I further agree to assume full responsibility for the minor’s safety and supervision throughout the period of Equipment use or participation in related activities.
SEVERABILITY CLAUSE: If any provision of this Agreement is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
INDEMNIFICATION: I agree to indemnify, defend, and hold harmless Idea Party Rentals Inc. and the Released Parties from and against any and all claims, liabilities, damages, losses, or expenses (including attorney fees, legal costs, and expenses) arising out of or related to the use or misuse of the Equipment, whether caused by negligence or otherwise.
MEDICAL EMERGENCIES: In the event of a medical emergency involving myself or my child(ren), I authorize Idea Party Rentals Inc. to obtain emergency medical care deemed necessary and agree to be financially responsible for any resulting medical expenses. I understand that every attempt will be made to contact me immediately in case of a medical emergency.
WEATHER AND EQUIPMENT RESPONSIBILITY: I understand that Idea Party Rentals Inc. is not responsible for delays, cancellations, or injury resulting from inclement weather. In the event of inclement weather or unsafe conditions, I agree to immediately stop using the Equipment, ensure participants are safely evacuated, and take responsibility for the safety of the participants and the Equipment during such times. I assume financial responsibility for any damage to the Equipment caused by misuse, abuse, or failure to follow safety guidelines. I also understand and agree that Idea Party Rentals Inc. reserves the right to cancel the booking if the weather is not suitable, and that I will not make any claims or pursue legal action for compensation or remuneration against Idea Party Rentals Inc. in such an event.
GOVERNING LAW: This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario. Any disputes arising from this Agreement shall be resolved in the appropriate courts of Ontario or through binding arbitration.
FINAL ACKNOWLEDGEMENT: I affirm that I have read, understood, and voluntarily agree to the terms of this Waiver and Release. I am not under duress, and no promises, inducements, or guarantees have been made to me. I am at least eighteen (18) years of age and legally competent to execute this Agreement. My signature below confirms my intent to release the Released Parties from all liability to the fullest extent allowed by law.
